I just watched a YouTube video of a guy that was busted for child porn.   Turns out the images were AI generated by him and not pictures of real kids.  They still busted him for possession of child porn and prosecuted as such.   Check it out.

The reason that child porn is an exception to protected speech is because to create child porn you need to harm a child.  AI generated images like cartoons do not involve and actual child.

If you watch the video, you will see that these weren't cartoon like images.  They were images of real looking children.   And that marks him as a sick fuck who needs to be locked up along with the Penn State coach.

I'm not watching the video, they'll be after me for receiving it.  I served on a Federal Grand Jury once, you had to serve for an entire year, and most of the cases brought had to do with child porn and sexual abuse of minors.  There really are some sick fucks out there; the worst had to do with an infant; a guy videoed his own kid and was selling the video on the internet.

The link I posted is safe for work.  It's a video clip of the cops questioning everyone, then eventually arresting the guy at his job.  Turns out, 45 states have made generating AI images of child porn illegal.

Being a sick fuck isn't a crime.  Harming children is a crime. 

Why should anyone cares if someone looks at AI images?   The problem with child porn is not in the viewing of it, but rather that the creation of child porn harms the child.  No children are being harmed by someone viewing AI generated porn.

State of mind is not a crime, actions are. 

I am sure this is no more realistic than the thousands of murders I have seen on TV and in movies.   Plenty of movies specifically point out that the scenes of animal abuse are CGI and that no animals were in fact inquired. 

Playing GTA is not a felony.  The whole premise of the game is dumb, but if you want to play it that is your business.  It is not a felony unless you steal a real car.  Likewise CGI or AI be it of murder or child porn is not the real thing. 

I want to protect children, not support authoritarian control over people.  Having legal and readily available AI generated images would go a long way to decrease the quantity of harmful child porn.

I brought this up to my sister the other day and I don't even feel all that comfortable openly discussing it, because supporting it makes you sound and feel like a pedo.

But this just doesn't sit right with me.  My whole issue with pedos isn't some morality judgment; it's that a minor's right are being violated.  I recognize that there's gray area, but while there is sexual perversion with AI porn, there is no victim.  It just feels like making the attraction against the law, rather than the act.  It plays like thought crime to me.

And not to mention how do you even legislate it?  What constitutes someone looking under 18?  What about drawings or art?  What about literature?  What about fake murder generated by AI?  The whole thing seems like a path I don't like going down.

I have no problem with making it illegal but I get why they can't. Same with child or teen nudity in movies. It should be illegal but its not as long as the parent signs off on it.
